ICC heeft lijst met minstens 200 vooraanstaande Israëliërs die zich schuldig hebben gemaakt aan oorlogsmisdaden en mensenrechtenschendingen

Aanklager Fatou Bensouda van het Internationaal Strafhof (International Criminal Court, ofwel: ICC) begon afgelopen december met een onderzoek naar oorlogsmisdaden en mensenrechtenschendingen tegen het verdrukte Palestijnse volk door Israëlische politici en officieren van het Israëlische leger.

Dit wekte zo'n grote woede in Israël en de VS, dat de laatste sancties instelde tegen leden van het ICC en hun familie, e.e.a. verwoord door opperploert en oorlogsmisdadiger Pompeo, die vicepresident mag spelen onder de andere grote oorlogsmisdadiger, president Trump..... Dacht eigenlijk zelf dat het ICC verder had afgezien van vervolging n.a.v. deze sancties, maar 'godzijdank' gaat de vervolging van Israël gewoon door. (wel stopte het ICC onderzoek naar oorlogsmisdaden begaan door de VS in Afghanistan......*)

De rapportages die intussen zijn gedaan door het ICC zorgen voor groeiende onrust in Israël, rapporten die figuren noemen als de fascistisch psychopathische Palestijnenslachter Netanyahu en zijn collega Gantz die een afwisselend premierschap zullen vervullen, de eerste 1,5 jaar de misdadiger Netanyahu en daarna Gantz, al evenzo een misdadiger van formaat.

Ongelofelijk trouwens dat het ICC Fatou Bansouda heeft aangesteld als aanklager, daar deze een smerige rol heeft gespeeld in Gambia, waar zij van 1998 tot 2000 minister van justitie was onder dictator Yahya Jammeh en zij de sharia wetgeving heeft geïntroduceerd in dat land..... Hoe dom moet je zijn om zo'n figuur aan te stellen als aanklager, daar komt op zeker stront van en ze wordt tot nu toe al meermaals genoemd als niet objectief (en gezien de feiten niet geheel ten onrechte; wat moet die figuur bij het ICC???)...... 


'Echte helden' van het Israëlische leger die een Palestijns jongen hebben gearresteerd......

Echter de feiten spreken voor zich en er is geen enkele twijfel aan de schuld van opvolgende Israëlische regeringen, de legertop en politie aan oorlogsmisdaden, misdaden tegen de menselijkheid, mensenrechtenschendingen en grove schendingen van kinderrechten, dit alles bij de vervolging van Palestijnse mensen....... Een vervolging waarbij vorig jaar nog grote aantal vreedzaam demonstrerende Palestijnen, kinderen, vrouwen, medisch hulpverleners en journalisten werden vermoord door militairen van de fascistische apartheidsstaat Israël.......  

Zoals zo vaak op deze plek verzucht, ieder ander land dat als Israël zo zou omgaan met een minderheid, was al lang onderwerp van sancties geweest....... Dan te bedeneken dat Israel in feite illegaal is gesticht en dat hoofdzakelijk op de grond van verdreven Palestijnen, die daar al generaties en eeuwen woonden..... De Verenigde Arabische Emiraten (VAE), moeten zich als Saoedi-Arabie en Egypte doodschamen dat men handelt met terreurstaat Israël...... (hoewel de genoemde staten zelf ook terreurstaten zijn....)

July 31, 2020 "Information Clearing House" - When International Court of Justice (ICC) Prosecutor, Fatou Bensouda, confirmed last December that the Court has ample evidence to pursue a war crimes investigation in occupied Palestine, the Israeli government responded with the usual rhetoric, accusing the international community of bias and insisting on Israel’s ‘right to defend itself.’

Beneath the platitudes and typical Israeli discourse, the Israeli government knew too well that an ICC investigation into war crimes in Palestine could be quite costly. An investigation, in itself, represents an indictment of sorts. If Israeli individuals were to be indicted for war crimes, that is a different story, as it becomes a legal obligation of ICC members to apprehend the criminals and hand them over to the Court.

Israel remained publicly composed, even after Bensouda, last April, elaborated on her December decision with a 60-page legal report, titled: “Situation in the State of Palestine: Prosecution Response to the Observations of Amici Curiae, Legal Representatives of Victims, and States.”

In the report, the ICC addressed many of the questions, doubts and reports submitted or raised in the four months that followed her earlier decision. Countries such as Germany and Austria, among others, had used their position as amici curiae – ‘friends of the court’ – to question the ICC jurisdiction and the status of Palestine as a country.

Bensouda insisted that “the Prosecutor is satisfied that there is a reasonable basis to initiate an investigation into the situation in Palestine under article 53(1) of the Rome Statute, and that the scope of the Court’s territorial jurisdiction comprises the West Bank, including East Jerusalem, and Gaza (“Occupied Palestinian Territory”).”

However, Bensouda did not provide definitive timelines to the investigation; instead, she requested that the ICC’S Pre-Trial Chamber “confirm the scope of the Court’s territorial jurisdiction in Palestine,” an additional step that is hardly required since the State of Palestine, a signatory of the Rome Statute, is the one that actually referred the case directly to the Prosecutor’s office.

The April report, in particular, was the wake-up call for Tel Aviv. Between the initial decision in December till the release of the latter report, Israel lobbied on many fronts, enlisting the help of ICC members and recruiting its greatest benefactor, Washington – which is not an ICC member – to bully the Court so it may reverse its decision.

On May 15, US Secretary of State, Mike Pompeo, warned the ICC against pursuing the investigation, targeting Bensouda, in particular, for her decision to hold war criminals in Palestine accountable.

The US slapped unprecedented sanctions against the ICC on June 11, with President Donald Trump issuing an ‘executive order’ that authorizes the freezing of assets and a travel ban against ICC officials and their families. The order also allows for the punishing of other individuals or entities that assist the ICC in its investigation.

Washington’s decision to carry out punitive measures against the very Court that was established for the sole purpose of holding war criminals accountable is both outrageous and abhorrent. It also exposes Washington’s hypocrisy – the country that claims to defend human rights is attempting to prevent legal accountability by those who have violated human rights.

Upon its failure to halt the ICC legal procedures regarding its investigation of war crimes, Israel began to prepare for the worst. On July 15, Israeli daily newspaper, Haaretz, reported about a ‘secret list’ that was drawn up by the Israeli government. The list includes “between 200 and 300 officials”, ranging from politicians to military and intelligence officials, who are subject to arrest abroad, should the ICC officially open the war crimes investigation.
Names begin at the top of the Israeli political pyramid, among them Prime Minister Benjamin Netanyahu and his current coalition partner, Benny Gantz.

The sheer number of Israeli officials on the list is indicative of the scope of the ICC’s investigation, and, somehow, is a self-indictment, as the names include former Israeli Defense Ministers – Moshe Ya’alon, Avigdor Lieberman and Naftali Bennett; current and former army chiefs of staffs – Aviv Kochavi, Benny Gantz and Gadi Eisenkot and current and former heads of internal intelligence, the Shin Bet – Nadav Argaman and Yoram Cohen.

Respected international human rights organizations have already, repeatedly, accused all these individuals of serious human rights abuses during Israel’s lethal wars on the besieged Gaza Strip, starting with the so-called ‘Operation Cast Lead’ in 2008-9.

But the list is far more extensive, as it covers “people in much more junior positions, including lower-ranking military officers and, perhaps, even officials involved in issuing various types of permits to settlements and settlement outposts.”

Israel, thus, fully appreciates the fact that the international community still insists that the construction of illegal colonies in occupied Palestine, the ethnic cleansing of Palestinians and the transfer of Israeli citizens to occupied land are all inadmissible under international law and tantamount to war crimes. Netanyahu must be disappointed to learn that all of Washington’s concessions to Israel under Trump’s presidency have failed to alter the position of the international community and the applicability of international law in any way.

Furthermore, it would not be an exaggeration to argue that Tel Aviv’s postponement of its plan to illegally annex nearly a third of the West Bank is directly linked to the ICC’s investigation, for the annexation would have completely thwarted Israel’s friends’ efforts aimed at preventing the investigation from ever taking place.

While the whole world, especially Palestinians, Arabs and their allies, still anxiously await the final decision by the Pre-Trial Chamber, Israel will continue its overt and covert campaign to intimidate the ICC and any other entity that aims to expose Israeli war crimes and to try Israeli war criminals.

Washington, too, will continue to strive to ensure Netanyahu, Gantz, and the “200 to 300” other Israeli officials never see their day in court.

However, the fact that a “secret list” exists is an indication that Tel Aviv understands that this era is different and that international law, which has failed Palestinians for over 70 years, may, for once, deliver, however a small measure of justice.

Internationaal Strafhof (ICC) stopt na bedreigingen met onderzoek naar VS oorlogsmisdaden.....

Ongelofelijk maar alweer waar: het Internationaal Strafhof (ICC) heeft het onderzoek stopgezet naar oorlogsmisdaden door de VS begaan in Afghanistan. De reden daarvoor zijn dreigementen en acties door de Trump administratie tegen het ICC, zoals een inreisverbod voor een ieder die meewerkt aan het onderzoek, bijvoorbeeld advocaten van slachtoffers.......

Hoe is het mogelijk dat de rest van de wereld en (vooral) Nederland na de dreigementen van de VS niet onmiddellijk zwaar protest hebben aangetekend??? Nederland dat zich ten onrechte keer op keer voordoet als het land van het internationale recht...

Domme vraag van mij, uiteraard geven andere landen hier geen commentaar op, daar een groot deel van de westerse landen in NAVO-verband heeft meegedaan aan de illegale oorlog van de VS tegen in feite de bevolking van Afghanistan......

Met deze beslissing van het ICC heeft dit strafhof haar eigen nek omgedraaid, al stond de geloofwaardigheid van het ICC al sterk onder druk na de eenzijdige vervolging van o.a. de oorlogsmisdaden begaan in voormalig Joegoslavië........ 

In voormalig Joegoslavië werden vooral Serven hard aangepakt, waar tegelijkertijd de VS en NAVO zelfs zonder onderzoek wegkwamen met een fiks aantal grote oorlogsmisdaden....... Iets dat het ICC eigenlijk altijd deed als het om westerse oorlogsmisdaden ging, totdat het ICC besloot de VS te onderzoeken op oorlogsmisdaden in Afghanistan, iets dat nu dus is teruggedraaid.... Ongelofelijk!!

Benieuwd hoe het staat met het ICC onderzoek naar oorlogsmisdaden door Israël begaan tegen het door haar vervolgde Palestijnse volk. Of is dat onderzoek na dreigementen uit de VS en Israël ook stopgezet??

ICC Decides Against Afghanistan War Crimes Investigation After US Opposition

(MEE) — The International Criminal Court (ICC) at The Hague has decided against opening a formal investigation into war crimes committed in Afghanistan after the United States made clear that it would never co-operate.

In a decision that is likely to seriously undermine the future stature of the court, it announced that it would not be proceeding – despite believing that war crimes were committed and that they fell within its jurisdiction.

The announcement by the court’s Pre-Trial Chamber came a week after the US revoked the entry visa of the senior ICC prosecutor, Fatou Bensouda.

Previously, US National Security Advisor John Bolton had made clear that his government would not only refuse to co-operate, but would seize the assets of Bensouda and her ICC colleagues and even prosecute them in the US criminal courts.

'“We will let the ICC die on its own,” Bolton said last year. “After all, for all intents and purposes, the ICC is already dead to us.”

Human Rights Watch condemned the decision, calling it “a devastating blow for victims who have suffered grave crimes without redress”.

Had the court decided to proceed with a formal investigation, it would have examined the actions of the Taliban and Afghan government as well as the United States.

In a statement, the court said: “The Chamber believes that, notwithstanding the fact all the relevant requirements are met as regards both jurisdiction and admissibility, the current circumstances of the situation in Afghanistan are such as to make the prospects for a successful investigation and prosecution extremely limited.

“Accordingly, it is unlikely that pursuing an investigation would result in meeting the objectives listed by the victims favouring the investigation.

“Thus the Chamber concluded that an investigation into the situation in Afghanistan at this stage would not serve the interests of justice and rejected the Prosecutor’s request for authorization to investigate.”

The US has not ratified the Rome Statute, the piece of international law that established the ICC in 2002 in order to prosecute genocide, crimes against humanity, war crimes and crimes of state aggression.

Afghanistan has ratified the statute, however, meaning the court has jurisdiction over crimes committed as a consequence of the war in that country since 1 May 2003.

In a preliminary report in 2017, Bensouda said there was a reasonable basis to believe that US forces personnel and CIA officers had been involved in the war crimes of torture and rape, and that the crimes committed at the agency’s so-called black sites in countries including Poland, Lithuania and Romania, had been “committed with particular cruelty.”

The evidence that the CIA and US forces had committed war crimes in Afghanistan includes the 2014 US Senate Intelligence Committee report, which drew upon the CIA’s own records to document human rights abuses that the agency committed in a global network of secret prisons; reports by the International Committee of the Red Cross; and findings by the European Court of Human Rights.

In the past, some African observers have accused the court of abandoning the pursuit of global justice in favour of the pursuit only of African leaders, and the failure to investigate the war in Afghanistan may provoke renewed calls for an African Union walkout.

Many African Union countries have expressed support for ousted Sudanese president Omar al-Bashir, who continued to travel widely in Africa and the Middle East despite being the subject of an ICC arrest warrant issued in 2009.

Sima Samar, the chair of Afghanistan’s Independent Human Rights Commission, said the decision was a disappointment for victims.

She told the Associated Press that it risked emboldening the perpetrators of crimes in Afghanistan, who were “at least a little fearful” of facing justice.

“With this decision, people will lose hope of getting justice and they might take revenge, fueling conflict in the country,” she said.

VS wordt eindelijk aangeklaagd voor oorlogsmisdaden bij Internationaal Strafhof (ICC)

Het werd tijd mensen, het aanklagen van de VS voor oorlogsmisdaden door het Internationaal Strafhof (ICC) in Den Haag. Jammer dat men de VS alleen daarvoor aanklaagt, immers er zijn ook nog de illegale oorlogen die de VS (met hulp van haar oorlogshond NAVO) keer op keer begint, op zich al enorme oorlogsmisdaden, dan zijn er nog de standrechtelijke executies middels drones, waarbij meer dan 90% van de slachtoffers niet eens werd verdacht....... Voorts zijn er de opstanden en staatsgrepen die de VS organiseert en regisseert, zaken waarbij meestal ook veel slachtoffers vallen... Tot slot zijn er dan nog de geheime militaire acties van de VS onder regie van de CIA en het manipuleren van verkiezingen in diverse landen, waarvoor je de VS ook nog eens kan aanduiden als cyberterrorist.......

Over terrorisme gesproken: de VS is de grootste terreurentiteit op aarde, waar dit 'land' ook nog eens verantwoordelijk is voor het terrorisme op de Europese straten en enorme vluchtelingenstromen......

Fatou Bensouda is hoofdaanklager bij het ICC en zij heeft een aanklacht wegens oorlogsmisdaden voorbereid, ze wacht nu nog op toestemming om de klacht in te dienen. Het gaat hier om het martelen van gevangen in Afghanistan van 2004 tot 2014...... Vreemd dat in die aanklacht niet meteen het martelen van gevangenen in Irak en Guantanamo Bay werd meegenomen........

Daar is echter een reden voor: volgens de regels zou het Internationaal Strafhof de VS alleen kunnen vervolgen, daar Afghanistan het Internationaal Strafhof erkent........ Wat is dat voor waanzin? Veronderstel dat men een inbreker alleen kan vervolgen als hij woonachtig is in de stad waar deze zijn/haar misdaden begaat.......

Maar niet gezeurd, de VS wordt eindelijk aangeklaagd, al heeft de zwaar corrupte regering van Afghanistan geprobeerd dit jarenlang tegen te houden.........

The US Could Finally Be Charged With War Crimes in Afghanistan

(ANTIMEDIA) The Hague, Netherlands — A prosecutor for the International Criminal Court (ICC) is pursuing a war crimes investigation against the United States for its conduct in Afghanistan following the 9/11 terror attacks.

Chief prosecutor Fatou Bensouda said last year that the U.S. military and CIA could be guilty of war crimes for its torture of detainees in Afghanistan between 2003 and 2014. The Guardian reported that “Bensouda’s report last year said the alleged US war crimes ‘were not the abuses of a few isolated individuals. Rather, they appear to have been committed as part of approved interrogation techniques in an attempt to extract ‘actionable intelligence’ from detainees.” Now, she is seeking approval from the court to move forward. According to the Guardian:

“Her request comes after an unusually long preliminary process, which has dragged on for 10 years because of a lack of capacity at the court as well as lobbying from the Afghan government, which tried to block it. The Afghan president, Ashraf Ghani, met with Bensouda as late as September during the UN general assembly.”

Bensouda also highlighted potential war crimes by the Taliban and the Afghan government, noting that overall, “10,000 civilians were said to have been killed from 2007 to 2011 alone,” the Independent noted. The Afghan government has resisted investigations, as has the U.S. Last year a State Department official said it was “unwarranted” and “unjustified.”

Nevertheless, Bensouda intends to investigate “crimes against humanity and war crimes such as murder, imprisonment, targeting humanitarian workers, use of child soldiers and carrying out executions without sentencing from the formal legal system,” the Guardian summarized.

Until 2016, the ICC had only investigated crimes in Africa, drawing criticism that it harbored a pro-western bias. It has since launched investigations in other parts of the world, including Iraq, Cambodia, Greece, Colombia, and Ukraine.

The United States is not a member of the court; during George Bush’s presidency, he declined to participate, claiming the U.S. could be unfairly attacked for political reasons. Though the U.S. is not a member, its officials could still be liable if found guilty because the crimes were committed in Afghanistan, which is a member.

The Guardian reported:

“The next step is for a pre-trial chamber of judges to consider the prosecutor’s request, which human rights observers in Kabul believe they will.”

Human Rights Watch said:

“Having documented egregious crimes in Afghanistan that have gone unpunished over many years, we hope this step will open a path to justice for countless victims there.”

Given the court’s previous aversion to prosecuting the U.S. for war crimes, it remains unlikely there will be any convictions. The Kuala Lumpur War Crimes Commission, launched as an alternative to the Hague-based ICC, previously found George Bush and Tony Blair guilty of “crimes against peace” during the Iraq War, but both men walk free.

The U.S. has long been accused of war crimes, including potential crimes in drone warfare, as well as during the Vietnam War.

Katherine Gallagher, a senior lawyer at the Center for Constitutional Rights (CCR) in New York, was pleased with the ICC’s move to potentially hold U.S. nationals accountable, especially in light of President Trump’s decision to increase troop levels (similar to the Obama administration).

“This long overdue message that no one is above the law is particularly important now, as the Trump administration ramps up military machinations in Afghanistan and embraces the endless war with no plan in sight,” she said.

According to Bensouda:

“For decades, the people of Afghanistan have endured the scourge of armed conflict. Following a meticulous preliminary examination of the situation, I have come to the conclusion that all legal criteria required under the [ICC’s] Rome statute to commence an investigation have been met.”

She also said:

“In accordance with the office’s policy and practice, the ultimate focus will be upon those most responsible for the most serious crimes allegedly committed in connection with the situation in Afghanistan.”
